Terms of Use

By accessing or using the Gensform website (gensform.com) or the Gensform web application (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all visitors, registered users, and anyone who accesses or uses the Service, whether as an individual or on behalf of a business.

Gensform provides an AI-powered social media content platform that enables users to generate, design, schedule, and publish content across social media platforms. The Service includes a web application, AI generation features, a content planner, and related tools.

Gensform is provided as a Software-as-a-Service (SaaS). We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

To access most features, you must create an account. You agree to:

• Provide accurate and complete registration information.
• Keep your password confidential and not share access with unauthorized parties.
• Notify us immediately at team@gensform.com if you suspect unauthorized use of your account.
• Accept responsibility for all activity that occurs under your account.

Gensform offers free and paid subscription tiers. Paid subscriptions are billed on a recurring basis (monthly or annually) via our third-party payment processor, Polar. By subscribing, you authorise us to charge your payment method for the applicable fees.

• Subscriptions auto-renew unless cancelled before the renewal date.
• Refunds are not provided for partial subscription periods.
• We reserve the right to change subscription prices with 30 days' notice. Continued use after the notice period constitutes acceptance of the new price.
• We reserve the right to suspend or terminate access for non-payment.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights.
• Generate, distribute, or publish content that is defamatory, harassing, obscene, or otherwise objectionable.
• Impersonate another person or entity.
• Circumvent platform rules of connected social media networks.
• Attempt to gain unauthorised access to the Service or its infrastructure.
• Scrape, reverse-engineer, or copy the Service's underlying code or models.
• Use the Service to train competing AI models.
• Spam, phish, or otherwise manipulate users of social platforms.

We reserve the right to suspend or terminate accounts that violate these rules at our sole discretion.

The Service uses artificial intelligence to generate text, images, and other content. You are solely responsible for reviewing, editing, and publishing AI-generated content. Gensform does not guarantee the accuracy, originality, or fitness for purpose of AI-generated outputs.

You are responsible for ensuring that content you publish complies with the terms of service of each social media platform and with applicable laws, including copyright, defamation, and advertising regulations.

Your content:You retain ownership of all content you upload to or create using the Service ("User Content"). You grant Gensform a non-exclusive, worldwide, royalty-free licence to use, process, and transmit your User Content solely to provide the Service.

Gensform IP: The Service, including its design, code, AI models, and branding, is owned by or licensed to Gensform. You may not copy, reproduce, or create derivative works from it without our express written permission.

The Service integrates with third-party social media platforms (e.g., LinkedIn, Instagram, X, TikTok, Facebook). Your use of those integrations is subject to the respective platform's terms of service. Gensform is not responsible for the actions, availability, or data practices of third-party platforms.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Gensform does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by applicable law, Gensform shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service.

Our total aggregate liability to you for any claim arising out of these Terms or the Service shall not exceed the amounts you paid to Gensform in the 12 months preceding the claim, or €100 (whichever is greater).

You agree to indemnify and hold Gensform harmless from any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or any applicable law.

You may terminate your account at any time from your account settings. Gensform may suspend or terminate your account with or without notice if you breach these Terms.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimer of warranties, and limitation of liability) shall survive.

These Terms are governed by and construed in accordance with the laws applicable in the jurisdiction where Gensform operates, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.

We may update these Terms at any time. We will notify registered users of material changes by email or prominent notice within the Service. Continued use after the effective date of any change constitutes your acceptance of the updated Terms.
